The Texas Department of Transportation (TxDMV), through its Vehicle Titles and Registration Division (VTR), allows individuals or companies to establish a Motor Vehicle Inquiry Account that allows for remote electronic access, through the Internet via a secure website, to motor vehicle title and registration records under certain conditions. To establish a Motor Vehicle Inquiry Account, a purchaser must enter into a written service agreement (Motor Vehicle Inquiry Service Contract for Accessing Texas Motor Vehicle Records) with the department, in accordance with the provisions of Texas Transportation Code, Section 502.008. Additionally, state and federal laws govern the release and use of personal data contained in the VTR database and provide for civil and criminal penalties for non-compliance with the provisions of these laws. Such laws include the federal Driver's Privacy Protection Act (18 U.S.C. 2721), and the Motor Vehicles Code, Chapter 730.
The laws mentioned above require the department to protect personal information contained in the VTR database concerning motor vehicle owners and lienholders, upon the request of the subject of the information. Only requestors who certify the intended use of the information is for one or more of the permitted uses listed in permitted uses listed in Attachment 'A' of the Motor Vehicle Inquiry Service Contract for Accessing Texas Motor Vehicle Records may have access to the privacy protected information. The department's automated system does not include a mechanism to restrict access to these privacy protected records for requestors who do not intend to use the information for a permitted use. Therefore, Motor Vehicle Inquiry Accounts will be established only for requestors who certify the intended use of the information is for one or more of the permitted uses.

The required Motor Vehicle Inquiry Service Contract for Accessing Texas Motor Vehicle Records outlines the conditions under which TxDMV may provide authorized access to the VTR database through the Internet, and stipulates restrictions regarding the use of such information obtained by virtue of this agreement. The restrictions apply to all contracted users and any third parties who may obtain VTR record information from the contractor. Each purchaser must comply with the provisions of the federal Driver's Privacy Protection Act and Texas Transportation Code, Chapter 730. Penalties for violating the restrictions specified in the contract will result in the immediate termination of the contract.
